Public Records Request Policy

The Board of Trustees of the San Miguel County Public Library District #1 adopts and makes public the following written policies:

The District fully supports and complies with all federal and state laws relating to the retention, protection, and disclosure of District records including, but not limited to, the Colorado Open Records Act, Colorado Revised Statutes § 24-72-200.1 et seq. (CORA), and Colorado Library Law, C.R.S. § 24-90-101 et seq. 

The Library Director is the official Custodian of Records responsible for the maintenance, care, and keeping of all library records. The Custodian of Records has the authority to designate such agents as appropriate to perform any acts necessary to enforce and execute the provisions of this policy. If any question arises as to the propriety of fully complying with a Records Request, the Custodian of Records will immediately forward it to legal counsel.

To request public records, contact the Custodian of Records/Library Director at San Miguel County Public Library District #1/Wilkinson Public Library, PO Box 2189, Telluride, CO 81435, or by filling out the CORA Request Form. Records requests must be in writing, and be specific as to the information desired. General emails to the District (or inquiries on the District’s website or social media sites) will not be treated as records requests under CORA. Requests must be submitted to and received by the designated records custodian.

All requests must contain the following information:

  • Description of the records being requested. Describe the request as specifically as possible with a description of the type of information, including date ranges.
  • If photocopies or electronic copies are being sought, please provide contact information and preferred method of delivery of the records.
  • Contact information should include: First and Last Name, Mailing Address, Email Address and Phone Number.

Fees for research and retrieval of public records may be imposed at the discretion of the records custodian as follows:

1st Hour – No Charge
More than 1 Hour – $30/hour

Hourly research and retrieval fees may be adjusted for inflation pursuant to C.R.S. § 24-72-205(b). Other fees may be imposed at the discretion of the records custodian consistent with the provisions of CORA. The Custodian of Records will include an estimate of the costs and fees that will be charged.  If fees are required, records will only be sent to the requester once the Custodian of Records either receives payment or makes arrangements for receiving payment for all fees lawfully allowed. 

Under normal circumstances, requested documents shall be made available within a maximum of five working days of receiving the request. If there are extenuating circumstances, as provided in the Act, up to an additional seven working days may be required. Working days for the Wilkinson Public Library are any day that the Library is open to the public.

Upon request for records transmission by a person seeking a copy of any public record, the Custodian of Records will transmit a copy of the record by U.S. Mail, facsimile, electronic mail, or other delivery service. 

The District will only produce those documents as permitted by CORA. Documents that are prohibited from disclosure under CORA will not be released.
