Policy for Reconsideration of Library Resources
The Board of Trustees of the San Miguel County Public Library District #1 [the District] has adopted the following policy.
The Library supports and believes in the freedom of information for all. However, community members have the right to request reconsideration of Library resources which includes materials, programs and displays.
All requests to reconsider must be made in writing using the Library’s Request for Reconsideration form available at the Library or online.
To make a request for reconsideration, the individual making the request must reside in the legal service area of the Library.
Individuals may submit no more than five requests for reconsideration resources per month.
The Library will not reconsider the same library resource more than once every 5 years.
The Library resource in question will remain available during the reconsideration process.
A request for reconsideration is an open record and not considered a Library User Record.
Steps in a Reconsideration Request
- Individual(s) completes and submits online or to the Library Director the Reconsideration Request form.
- Library Director, in consultation with Library staff/selectors, will review the request and the Library resource in question to consider whether the selection follows criteria stated in appropriate Library policy.
- Within 30 days, the Library Director will notify the individual(s) in writing of the decision and state the reasons for the decision.
Steps in a Reconsideration Appeal:
- Individuals not satisfied with the decision of the Director, within 10 days of receiving the decision, may request a review by the District’s Board of Trustees at their next meeting by making a written request to the President of the Board. Upon receipt of the request, the Board may make the request an agenda item and the individual(s) will be notified of the time and place of the Board meeting. The Board reserves the right to limit the length of presentation and number of speakers at the meeting.
- After hearing from the person(s) making the reconsideration request, the Board will determine whether the request for reconsideration has been handled in accordance with stated policies and procedures of the District. The District will review the background information provided by the library staff, will review the position of the patron and will also review the decision of the Director.
- Based on the information presented, the Board may vote to uphold or override the decision of the Director. The decision of the Board is final. Once a final determination is made, the Board of Trustees will make the result public.
