Photography, Video and Recording Policy

The Board of Trustees of the San Miguel County Public Library District #1, Wilkinson Public Library, adopts and makes public the following written policies.

The Wilkinson Public Library is a public space. Therefore, consent for use of passive photos/recordings is assumed upon entering the Library or participating in library events. To the extent applicable, any record or other information that identifies a person as having requested, obtained, or used specific library materials or services may be disclosed by the Library in conformance with C.R.S. § 24-90-119, as amended.

Members of the public and staff are permitted to take photos or recordings in open, public areas of the Library for personal, non-commercial use. As a courtesy, patrons (especially those accompanying minors) and staff should be consulted before being photographed or recorded. If a patron or staff member does not wish to be photographed/recorded, they must notify the photographer/videographer. Photographic equipment (i.e., tripods or lighting) is prohibited without prior authorization by the Library Director.

To protect the privacy of library patrons and staff, photos and video are restricted or prohibited in certain library locations, including, but not limited to, restrooms, parental/caregiver support areas (i.e., nursing), and areas reserved for staff use only.

Library staff reserves the right to ask any individual or group to cease taking photos or videos when it compromises public or staff safety/security or interferes with library operations. Photographers/videographers are asked to be respectful and refrain from disturbing other library users and staff; a repeated failure to do so may result in removal from the Library premises. While photos and videos of publicly available collections are permitted, patrons are solely responsible for obtaining consent or other permission when capturing copyrighted materials.

The Library reserves the right to use photographs, audio, and/or visual recordings taken at the Library or Library events for Library purposes, including marketing or promotional efforts. This use includes print and digital marketing, editorial publication, and/or any other communication format related to the support of the Library’s services. If the Library staff solicits a patron for a photograph/recording intended for a system-wide promotional campaign, they may be asked to complete and sign a Release Form. Reasonable efforts will be made to respect the wishes of patrons who do not want to be photographed, filmed, or recorded.

Security Cameras
The Library premises may be under video surveillance or security cameras may be used to serve as a potential deterrent and means of identifying and prosecuting offenders. While adhering to applicable federal, state, and local laws concerning the confidentiality of library records, the disclosure of public records, and the protection of individual privacy, the Library’s surveillance system will be used only for the identification of persons breaking the law or violating Library policies and for the protection of patrons, staff, assets, and property.
